Pixenlarge End User License Agreement
IMPORTANT - PLEASE READ CAREFULLY
Notice to user: Please read this
agreement carefully by copying, installing or download Pixenlarge you
accept all the terms and conditions of this agreement. This
Agreement, between you and Bigfields Software, covers all users of
Pixenlarge on this computer. This means by accepting this agreement
you are responsible for all users on this computer. If you don't
accept this agreement, then please remove Pixenlarge from your
computer.
If you have bought a license key, then
you are responsible for this key. It is strictly forbidden to copy or
distribute this key to someone else.
Legal restrictions: If the laws
of your country prevent you from signing a legally binding agreement
for the Pixenlarge because, for example you are under the age limit
to sign such an agreement, then please remove Pixenlarge from your
computer.

1. Definitions
The following terms and expressions
shall have the following meanings in this agreement:
1.1 Additional Terms: The terms
and conditions and policies applicable to your use of the Pixenlarge,
in addition to this Agreement.
1.2 Agreement: This End User
License Agreement.
1.3 Documentation: Any online or
otherwise enclosed documentation for Pixenlarge provided by Bigfields
Software.
1.4 IP Rights: Is a abbreviation
for Intellectual Property Rights, which includes patents, pending
patent applications, designs, trade marks and trade names (whether
registered or unregistered), copyright and related rights, know-how
and confidential information. This also includes all other
intellectual property rights and similar or equivalent rights
anywhere in the world which currently exist or are recognized in the
future.
1.5 Bigfields Software: Refers
to Mattias Nilsson i.e. publisher and owner of all IP Rights to
Pixenlarge. Webpage: pixenlarge.com. Address: Mattias Nilsson,
Mintensgatan 3a, 416 63 Göteborg, Sweden.
1.6 Bigfield Software's Promotional
Materials: Any and all trademarks, names, signs, logos and any
other materials, in whatever form, owned and/or used by Bigfields
Software for the promotion of its company, its products, its
intellectual materials and activities.
1.7 Terms: Has the meaning given
in the "Additional Terms" preliminary term above.
1.8 You: You, the end user of
the Pixenlarge, also used in the form "Your" where
applicable.
1.9 Computer: Means a computer
device that accepts information in digital or similar form and
manipulates it for a specific result based on a sequence of
instructions.
1.10 Pixenlarge: This means all
of the information for Pixenlarge provided by Bigfields Software,
including but not limited to the Pixenlarge's software files and
documentation for Pixenlarge.
1.11 Reverse Engineering: Means
the process of discovering the technological principles of a software
through e.g. analysis of its structure, function and operation.
1.12 Decompile: Means performing
a reverse compile operation. I.e. translate software's low level
instructions (machine language or Assembly language) back to high
level code (often C, C++, Pascal or Ada).
1.13 Disassemble: Means
performing an inverse operation to that is performed by an assembler.
I.e. translate software's machine language instructions to Assembly
language code (often formatted for human-readability).
2. License and Restrictions
2.1 Software License: If you
obtained the Software from Bigfields Software, bought a license key
and as long as you comply with the terms of this agreement, will
Bigfield Software grants you a non-exclusive license to use the this
Software in the manner and for the purposes described in the
documentation and this agreement, as further set forth below.
2.2 General Use: You may install
and use only one copy of Pixenlarge per license.
2.3 Right of withdrawal: Due to
the license key's nature, it can’t be returned. Therefore,
there is no right of withdrawal when buying a license key.
2.4 No use from server: It is
not permitted to use this software from a server so Pixenlarge can be
used from other computers.
2.5 Ownership of IP rights:
Bigfield Software owns all intellectual property to Pixenlarge,
including documentation. The software -structure, -organization and
-code are the valuable trade secrets and is confidential information
of Bigfields Software. The Software is protected by law, including
but not limited to the copyright laws of the Sweden and other
countries, and by international treaty provisions. This agreement
does not grant you any intellectual property rights to the Software.
I.e. the software is only licensed, it is not sold. All IP Rights to
Pixenlarge are and shall remain the exclusive property of Bigfields
Software. Nothing in this Agreement intends to transfer any such IP
Rights. You are only entitled to the limited use of the IP Rights
granted to you in this Agreement. You are not allowed to take any
action to jeopardize, limit or interfere with Bigfields Software's IP
Rights. Any unauthorized use of Bigfields Software's IP Rights is a
violation of this Agreement as well as a violation of intellectual
property laws and treaties, including without limitation copyright
laws and trademark laws. It is only permitted to download, install
and try out in demo mode for maximum of 30 days or use after purchase
of license. All other use is strictly forbidden.
2.6 No Modifications or Reverse
Engineering: You may not modify or adapt the Pixenlarge or any
part of it. You may not reverse engineer, decompile, disassemble, use
any form of analyze tool on Pixenlarge or in otherwise attempt to
discover the source code of the Software.
2.7 Bigfields Software's Promotional
Materials: Nothing in this Agreement will give you any right to
use the Bigfields Software's promotional materials.
2.8 No Transfer: You may not
rent, lease, sell, sublicense, assign or transfer your rights in this
software or authorize any portion of the software to be copied onto
another individual or legal entity's computer.
2.9 Updates: If the Software is
an upgrade or update to a previous version of Pixenlarge, you must
possess a valid license to this new version in order to use such
upgrade or update. I.e. the two first numbers in the version number
must be same on your license key as the in the updated software.
After you install such update or upgrade, you may not continue to use
the previous version on another computer. I.e. the license is only
valid for one installation of Pixenlarge.
3. Disclaimer of Warranties and
Limitation of Liability
3.1 No Warranties: The
Pixenlarge is provided "as is" with no warranties
whatsoever. Bigfields Software will not, either expressed, implied or
statutory, give any warranties for the Pixenlarge, including, without
limitation, warranties or conditions of quality, performance or
fitness for use for a particular purpose. Bigfields Software does not
warrant that the Pixenlarge will always be accurate, complete and
error-free.
3.2 Your own Risk: You
acknowledge and agree that the entire risk arising out of your use of
the Pixenlarge remains with you.
3.3 No Liability: Accordingly,
you acknowledge and agree that Bigfields Software will have no
liability in connection with or arising from your use of the
Pixenlarge, as set forth below. Your only right or remedy with
respect to any problems or dissatisfaction with the Pixenlarge is to
immediately uninstall and cease use of Pixenlarge.
3.4 Limitation of Liability: In
no event shall Bigfields Software be liable, whether in contract,
warranty, tort (including negligence), product liability or any other
form of liability, for any indirect, incidental, special or
consequential damages (including without limitation any loss of or
corruption to data, interruption, computer failure or pecuniary loss)
arising out of the use or inability to use the Pixenlarge.
4. Additional Terms
In addition to this Agreement, You have
to comply with the following Additional Terms when receiving the
Pixenlarge. We expect You to read these Additional Terms carefully,
all of which are made part of this Agreement:
4.1 Distribution of Pixenlarge:
You are not allowed to distribute the Pixenlarge or any part of it.
Bigfields Software has exclusive distribution rights to Pixenlarge.
